… As Court Orders Reinstatement Of His Name In National Register Of Chiefs

Counsel to the Gbese Mantse, Nii Ayi Bonte II, Nii Bi Ayi Bonte has expantiated clearly the fact that a competent Court of Jurisdiction has ordered that the name of his client (Nii Ayi Bonte II) be re-entered into the National Register of Chiefs following its removal.
20150228_101600According to him, the National House of Chiefs after neglecting several orders to do so, has finally carried out an order giving in a ruling on 21st November, 2014 by His Lordship Justice Jacob B. Boon.
At a press conference organised by the Principal Kingmaker and elders of the Gbese stool, Nii Ayi Bonte II who took time to explain the content of the said ruling indicated that, the appeal filed against a judgement that Nii Ayi Bonte’s name be re-instated in the register was null and void.
However, the said judgement as delivered by Justice B. Boon stated that, “……I am of the firm conviction that the motion he (Ayikoi Otoo) filed on 7/11/14 for an order of the court to suspend the ruling of this court of the same date, pending an appeal filed at the Court of Appeal against the said ruling has no merit.”
The judge also went on to state that, “I will therefore uphold the oral application by lawyer for the Applicant in that ruling by striking out the motion to suspend in the Register of the National House of Chiefs, and further order the National House of Chiefs to carry out the order of this court of 7/11/14 forthwith. Leave is further granted for the motion filed by counsel for the Applicant Nii Ayi Bonte II, dated 14/11/14 to be withdrawn.”
Nii Bi Ayi Bonte who act as a supporting counsel and Communications Director for the Gbese Stool also went on to explained that, on November 7, 2014, His Lordship Jacob B. Boon also delivered another judgement in a case involving the Republic vrs National House of Chiefs, Ex-Parte Nii Ayi Bonte II (Nii Okaidja III Interested Party), he stated clearly that, “….This court has time without number held that the reliefs open to a party who invokes the supervisory jurisdiction of this Court which is in pari materia with the supervisory jurisdiction of the High Court is not limited to the traditional prerogative writs or any particular remedies for that matter.”
According to the judge, the decision to delete Nii Ayi Bonte II’s name from the register of chiefs has been quashed and that, “It is only reasonable and appropriate for the court to order the name to be restored as the Gbese Mantse. I order the Respondent to restore the name of the Applicant in the National Register of Chiefs within seven days from today.”
However, addressing the press conference, Nii Okai Kasablofo III, Dzaasetse and Principal King maker of the Gbese Stool indicated that the Ga Traditional Council has also unanimously declared that Nii Ayi Bonte II as the legitimate Gbese Mantse.
He averred that, a judgement from the Ga Traditional Council stated after considering the lineage of chieftaincy in the Gbese area that, “In all the circumstances we accept the Plaintiff’s case (Nii Ayi Bonte II) and reject that of the Defendant including his counterclaim. We therefore give judgement for the Plaintiff for the 1st and 3rd reliefs sought by Plaintiff’s Writ of Summons. That is to say”:
“…We hereby declare that Nii Ayi Bonte II of the 3rd Ruling House of Gbese called Naa Akua Onidin We a.k.a Akwetey Krobo Saki We, is the true and duly installed Gbese Mantse, so installed on 27th April 2007 in succession of the late Gbese Mantse Nii Okai Pesemaku III of the 1st Ruling House of Gbese called Pensiaku We a.k.a Shia Wulu, in accordance with Gbese customary law and usage and in accordance also with the Gbese Stool Rational Succession Agreement dated 23rd September 1941 signed by the accredited representatives of all the three Ruling Houses of Gbese.”
The ruling also stated that, “We further hereby declare that Nii Okaidja III a.k.a Bill Okaidja Annan was never a successor to Nii Ayitey Agbofu (in private life known as Emmanuel Ayitey Tagoe) since the said Nii Ayitey Agbofu II was purported to have been installed Gbese Mantse from the 1st Ruling House of Gbese namely Pensiaku We or Shia Wulu, well after the Head and elders of the 1st Ruling House had in 1959 handed over the cloth or mantle of Gbese Mantse Nii Okai Pesemaku III (of the 1st Ruling House) to Nii Amarteifio and his elders as Head and Elders of the 3rd Ruling House to be the next Ruling House to install the next Gbese Mantse in succession to the said Nii Okai Pesemaku III in conformity with the 1941 Rotational Succession Agreement.
The Ga Traditional Council in its ruling therefore awarded a cost of GH?5,000.00 to be paid by the defendant.
However, he is entitled to appeal against the said judgement.
