CCTV footage will not have any bearing in KKD’s Rape case

A senior Law lecturer at the Faculty of Law of the University of Ghana, Kissi Agyabeng has said extraneous news events surrounding the ?KKD rape saga? will not have any impact on the outcome of the case in Court.

The managing partner at Cromwell Gray LLP told Kweku Obeng Adjei on Starr FM?s Morning Zoo programme Saturday January 3, 2015 that the recent leakage of the CCTV video, which captured the accused person, Kwesi Kyei Darkwah, and his alleged rape victim, Ewuraffe Orleans Thompson, at the African Regent Hotel where the alleged sexual assault happened, will not affect the case.

??Whatever evidence that will be put before the court is what will affect the case. What is going on outside of the courtroom will not affect the case.

?The Court is not going to consider extraneous material. It is the evidence that is adduced before the court?that is what the court will look at to determine the gentleman?s criminal liability or otherwise so forget about what we are doing on social media,? Agyabeng emphasised.

KKD is currently in the custody of the Airport Police Command after his arrest on Saturday December 27, 2014 after the alleged seksual assault.

The 19-year-old student reported the matter to the Police the same night after the alleged seksual assault happened in the bathroom of a suite at the hotel.

The embattled CEO of Finest Productions has been remanded till January 8, 2015.

According to the facts sheet, the 49-year-old accused broadcaster ?forcibly had seks with the complainant.? KKD, however insists the seks was consensual.

His Lawyers have filed an application for his bail at the Human Rights Court. That case is billed to be heard on January 7, 2015, just a day before KKD?s reappearance before a District Magistrate Court in Accra, where he made his first appearance and was denied bail.
